1.2. All content is protected by international copyright laws, intellectual property treaties, and applicable national laws including but not limited to Romanian copyright law (Law 8/1996), the Berne Convention, the WIPO Copyright Treaty, and applicable EU Copyright Directives.

1.3. Copyright protection exists from the moment of creation and does not require registration. Content may additionally be registered with collecting societies (including UCMR-ADA) and/or identified by ISRC codes.

1.4. No ownership, copyright, or intellectual property rights are transferred to you by accessing this website.

1.5. All rights not expressly granted herein are strictly reserved by the owner.

2. LIMITED LICENSE FOR PERSONAL USE

2.1. You are granted a limited, non-exclusive, non-transferable, revocable license to access and stream content on this website for personal, non-commercial enjoyment only.

2.2. This license does NOT permit you to:

  • Download, save, copy, reproduce, or duplicate any content
  • Record, capture, or rip any audio or radio streams
  • Distribute, share, publish, or transmit any content to third parties
  • Use any content for commercial, business, or promotional purposes
  • Synchronize any content with visual media (video, film, advertisement)

3. COMMERCIAL LICENSING

3.1. ALL commercial use of any content requires a separate, written licensing agreement.

3.2. Commercial use includes but is not limited to: advertising, marketing, film, television, video production, podcasts, social media monetization, public performance, broadcasting, streaming services, video games, apps, and any revenue-generating activity.

3.3. Four license types are available: Standard License, Extended Broadcast License, Custom / High-End License, and Political & Advocacy Use.

3.4. Standard Licenses may be purchased online via the track page licensing system. All other license types require direct negotiation.

3.5. Licensing fees and terms are determined solely by the owner.

3.6. No license is granted until a written agreement is executed and full payment is received.

4. LIQUIDATED DAMAGES & PENALTIES

🚫 The following penalties apply as pre-estimated liquidated damages (clauză penală) in accordance with the Romanian Civil Code (Art. 1538–1543).

4.1 Unlicensed Use: Penalty of 10× (ten times) the applicable Standard License fee. Minimum: €15,000.

4.2 Scope Violation: Penalty of 3× (three times) the applicable license fee for the actual scope.

4.3 Post-Expiration Use: Penalty of €250 per day.

4.4 Content ID / Registration Violation: Penalty of €25,000 plus all resolution costs.

4.5. These penalties are cumulative and do not limit other legal remedies.

5. INJUNCTIVE RELIEF

⚠ The owner is entitled to seek immediate injunctive relief (including takedowns, DMCA notices, and court orders) without bond requirement.

6. RADIO STREAM

6.1. The live radio stream is provided for personal listening enjoyment only.

6.2. You may NOT:

  • Record, capture, or rip the radio stream
  • Rebroadcast, redistribute, or retransmit the stream
  • Use the stream for public performance or commercial purposes
  • Embed the stream on other websites without written permission

6.3. The radio stream may be interrupted, modified, or discontinued at any time without notice.

7. THIRD-PARTY LINKS & PLATFORMS

7.1. This website may contain links to third-party platforms (Spotify, YouTube, Apple Music, etc.).

7.2. These links are provided for convenience only.

7.3. Your use of third-party platforms is governed by their respective terms of service.

8. USER CONDUCT

8.1. By using this website, you agree NOT to:

  • Violate any applicable laws or regulations
  • Infringe upon any intellectual property rights
  • Attempt to circumvent any technological protection measures
  • Use automated systems, bots, or scrapers to access content
  • Interfere with or disrupt website operations
  • Attempt unauthorized access to any systems or data

10.2. The owner is not liable for claims arising from content in which licensed music is used by any licensee.

10.3. YOUR SOLE REMEDY IS TO DISCONTINUE USE.

11. INDEMNIFICATION

11.1. You agree to indemnify, defend, and hold harmless the owner from any claims, damages, losses, liabilities, costs, and expenses arising from your use, violation of these terms, or infringement of any intellectual property rights.

12. MODIFICATIONS

12.1. The owner reserves the right to modify these terms at any time without prior notice.

12.2. Continued use constitutes acceptance of the new terms.

13. TERMINATION

13.1. The owner may terminate your access at any time, for any reason, without notice or liability.

14. GOVERNING LAW & JURISDICTION

14.1. These terms are governed by the laws of Romania, including Law 8/1996, the Romanian Civil Code, and applicable EU directives.

14.2. International copyright protections apply under the Berne Convention, WIPO Copyright Treaty, and WIPO Performances and Phonograms Treaty.

14.3. The courts of Romania shall have exclusive jurisdiction.
